Wisent Software ("we," "us," or "our") operates the Wisent mobile and web applications ("App" or "Service"). This Privacy Policy explains how we collect, use, disclose, and protect personal information when you access or use our Service, including participation in our closed beta program. By using the Service, you acknowledge that you have read and understood this Policy.

Our Service employs AI-driven technologies from various providers, including but not limited to OpenAI LLC (ChatGPT), Anthropic PBC (Claude), Google LLC (Gemini), and other AI services and tools. AI outputs may contain inaccuracies, and you agree that Wisent Software is not liable for the content or consequences of any automated responses.

2. Scope and Applicability

This Policy applies to all users located in North America and the European Union. It complies with the GDPR (EU 2016/679), CCPA/CPRA, COPPA, and other applicable U.S. and international privacy laws.

3. Information We Collect

We collect the following categories of personal and technical data:

Identification Data: Name, email address, phone number.
Account Credentials: Authentication tokens via Google, Apple, Microsoft, or email OTP.
Usage Data: Interactions, feature use, time stamps, crash logs, and performance metrics.
Device Data: Device ID, OS, browser type, IP address, and metadata.
Location Data: Approximate geolocation derived from device or IP.
Analytics Data: Collected via PostHog and internal telemetry.
Financial Data: Transaction IDs and purchase metadata processed by Stripe, RevenueCat, or Polar.sh (we do not store full payment details).
AI Input Data: Prompts, queries, or text that you provide for AI processing.

4. Purpose of Processing

We process data for the following legitimate business purposes:

Account creation, maintenance, and security.
Operation, improvement, and personalization of the App and Services.
Provision and enhancement of AI-assisted functionality.
Processing of in-app purchases, subscriptions, and donations.
Analytics, fraud detection, and system integrity.
Legal and regulatory compliance.
Administrative and support communications.

5. AI Processing and Automated Decision-Making

User inputs may be transmitted to third-party AI processors, including but not limited to OpenAI, Anthropic PBC, Google LLC, and other AI service providers. We may use additional AI models and services at our discretion, particularly during beta programs, without prior notice to users. Prompts and AI responses may be stored and logged for up to five (5) years for product improvement, debugging, and model evaluation. AI-generated responses are produced algorithmically without human review and may not be accurate, factual, or appropriate for all contexts. Users should not rely on these responses for legal, financial, medical, or safety-critical decisions. By using these features, you consent to automated decision-making within the scope of the Service.

6. Legal Basis for Processing (EU Users)

7. Data Retention

We retain personal data, user-generated content, and AI interaction data for up to five (5) years from the date of last account activity. After this period, data will be automatically deleted or anonymized unless retention is required by law, for fraud prevention, security purposes, or other legitimate business needs. When retention is no longer necessary, data are securely deleted or anonymized in accordance with industry best practices.

8. Data Sharing and Disclosure

We may share information with:

Service Providers: Hostinger (Phoenix Data Center), PostHog, Stripe, RevenueCat, Polar.sh, and other service providers as needed.
AI Vendors: OpenAI, Anthropic, Google LLC (Gemini API), and other AI service providers.
Regulatory Authorities: as required by law or to enforce rights.

All third-party processors are contractually bound to handle data in accordance with this Policy and applicable privacy laws. All payment processors certify compliance with PCI-DSS standards for secure payment handling.

9. Cookies and Tracking

Our website and web App may employ cookies and similar technologies for analytics and performance measurement. You may disable cookies through your browser or system settings, though some functionality may be limited.

10. User Rights

10.1 European Union Residents:

You have the right to access, correct, or delete your data; restrict or object to processing; withdraw consent; and request data portability. Requests may be sent to support@wisentapp.com; responses will be provided within statutory GDPR periods.

10.2 California Residents:

Wisent Software does not sell or share personal information as defined under the CCPA. We do not use personal information for cross-context behavioral advertising. You may request disclosure or deletion of your personal information subject to legal exceptions.

11. Children's Privacy

Our Service is not directed to children under 13 years of age. We do not knowingly collect personal data from children without verifiable parental consent. If such data are identified, they will be deleted immediately. Parents or guardians may contact support@wisentapp.com to request deletion.

12. Data Security

We employ Transport Layer Security (TLS) and other administrative, technical, and physical safeguards to protect information against unauthorized access, disclosure, alteration, or destruction. However, no electronic system is entirely secure; users participate in the beta program at their own risk.

13. Beta Program Disclaimer

The Wisent App is offered as a closed beta program. You acknowledge that the Service may contain bugs or incomplete features. Wisent Software disclaims any liability for damages, data loss, or issues arising from beta participation, AI responses, or system instability. Use is at your sole risk, and no warranty—express or implied—is provided during the beta period.

14. International Transfers

Information may be transferred and processed in the United States, including by our processors in Phoenix (Hostinger). By using the Service, you consent to such transfers in accordance with GDPR Standard Contractual Clauses.

15. Data Deletion and Account Termination

Users may delete their accounts and associated data:

Through in-App account settings; or
By signing into the web portal at https://wisentapp.com.

Upon verification, data will be deleted or anonymized within thirty (30) days unless retention is legally required.

16. Data Processing Addendum

Wisent Software maintains a Data Processing Addendum consistent with Article 28 of the GDPR, available upon request.

17. Changes to This Policy

We may update this Privacy Policy at any time, with or without notice. Changes may be posted on our website with the updated effective date. Continued use of the Service after any modification constitutes acceptance of the revised Policy. We encourage you to review this Policy periodically to stay informed about how we protect your information.
